Car Accident Involved with a drunken driver, what to do?
Many insurance companies quite reasonably refuse to pay up if the driver they have insured is breaking the law when involved in an accident. This may include driving while disqualified or while having a higher blood alcohol level than the law permits. This is another reason not to drink and drive.
If the other party in an accident has clearly been drinking, and there are no police in attendance, you face a moral dilemma. By calling the police and getting the other driver charged with `drink driving’, you will have facilitated justice, but may also have invalidated the driver’s insurance.
If the ‘drink driver‘ does not otherwise have the money to pay for the damage caused to your car, you might have to claim on your own insurance (and lose your no-claim bonus) or embark on a lengthy legal battle.
It is worth checking how your insurance company treats such a situation. Some have a ‘no-fault’ clause which says that if you can identify the party at fault they will pay for your damage without cancelling your no-claim bonus.
